2010 Changes
November/December 2010:
We've come to the end of another year. This year saw (less by conscious
decision than happenstance) this website move to bimonthly updates. It
also saw some major construction projects begin (such as the reshaping of
the Sepulveda Pass), some significant completions (such as the tunneling
at Devil's Slide), and loads of maintenance thanks to stimulus funds. It
also saw the further decline of misc.transport.road into uselessness, and
the growth of Facebook as a communication medium. Speaking of that, if you
haven't friended the California Highways Facebook group, you should. I've set it up to get the regular Metro.Net headline posting, and I regularly highlight any highway
related articles I find on the net. It is also your place to share news
about California Highways, and I pick up that news from there for these
updates. So join!
The following are updates from my reading of the papers (which are posted
to California Highways Facebook group) as well as any backed up email changes. I also reviewed the the AAroads forum and misc.transport.road. This resulted in changes on the following routes, with credit as indicated [my research(1),

Noted an interesting article from Metro.Net that, alas, doesn't quite fit into any specific highway page nor other pages I have on the site. This
article reported on a study exploring the feasibility of conversion of existing HOV lanes in Southern California to HOT lanes. The study had the following key
findings:
Constructability: Route 60 (Brea Canyon Road to Azusa Avenue)
rated the highest for ease of constructability. Others rated high for
ease of construction were I-105, Route 14, and Route 57. These
facilities have the preponderance of standard land and shoulder widths,
available right-of-way, flat topography, at-grade segments, and minimal
interference with utilities and rights-of-way. Five HOV facilities rated
medium in this category: I-5, I-210, I-405 north of LAX, I-405 South,
and Route 60 (Route 57-Route 71).
Revenue Potential: I-405 North of LAX rated the highest for
revenue generating potential. Four HOV facilities were rated medium in
this category: I-105, I-210, Route 14, and Route 91.
Connectivity: I-605 rated the highest in this category, followed
by I-5, and I-105.
Transit Benefits: I-5 rated the highest in this category,
followed by I-10, and I-405 north of LAX.
Based on the Study findings, the following HOV facilities appeared to
demonstrate comparatively strong potential for HOT conversion and were
recommended for further assessment in the event additional studies are
undertaken in Los Angeles County: (1) I-105, from I-405 to I-605; (2)
I-405, from I-105 to I-5 north of LAX; (3) Route 91, from I-110 to the
Orange County Line; (4) Route 57, from Route 60 to the Orange County Line.
Additional consideration was also felt to be warranted for I-10 between
I-605 and the San Bernardino County Line.
Another interesting article of note is this one from the Sacramento Bee, which explores the increasing use of auxilliary lanes on Sacramento freeways. Aux lanes are short-distance
lanes that run from an onramp to the next offramp. They don't require
environmental studies. Caltrans is now linking up series of lanes in
Sacramento to improve traffic flow at lower cost. Caltrans currently wants
to link several auxiliary lanes on I-80 in Roseville and create similar
linkages on Route 99 in south Sacramento.
Checked the Calnexus page to see if there had been any updates. There weren't any.
Reviewed the Pending Legislation page. This is a new legislative session, and only a few bills have been
introduced yet, and no bills have even progressed out of committee.
I checked the CTC Liaison page for the results of the November meeting. The following items were of interest:
- 2.1a. Program Amendments/Project Approvals – STIP
Amendments for Action
(1) The Department and the Kern Council of Governments (KCOG) propose
to amend the 2010 STIP to revise the funding plan for the Route 46
Expressway – Segment 4 project (PPNO 3386B), reduce the
programming for KCOG’s Planning, Programming and Monitoring
(PPNO 6L03), and program two new projects, the 7th Standard Road
8-Lane Route 99 from Route 204 to Beardsley Canal
project (PPNO 6267) and the Taft Highway 8-Lane Route 99 from Route 119 to Wilson Road project (PPNO 6268). Approved.
(3) The Department and the Orange County Transportation Authority
propose to amend the TCRP Program to designate the Kraemer Boulevard
Undercrossing Project as TCRP Project 73.1 and program $1.46 million
to construction. Approved.

(1) The Department and the Tehama County Transportation Commission
propose to amend the Route 99 corridor baseline agreement and the 2010
STIP for the Route 99 Los Molinos project (PPNO 02-3326) to update the
project scope, schedule and funding plan for Phase 2. Information
only.
(2) The Department and the Merced County Association of Governments
propose to amend the 2010 STIP to delete the Route 59 Widening project
(PPNO 6688) and add the Atwater-Merced Expressway Phase 1A project
(PPNO 5264A). Information only.
- 2.1c. Traffic Congestion Relief (TCR)Program Application
Approvals/Amendments, Proposition 1B CMIA Program/Project Amendments
Proposition 1B CMIA Program Amendments
(1a) The Department and the Los Angeles County Metropolitan
Transportation Authority propose to amend the CMIA baseline agreement,
the 2010 STIP, and the SLPP program for the Route 5 Empire Avenue
Interchange project (PPNO 3985) and the Route 5 Burbank Boulevard
reconstruction project (PPNO 3986) to combine the two projects for
staging and construction purposes and to revise the schedule and
funding plan accordingly. Information only.
(1b) The Department proposes to amend the CMIA baseline agreement and
the 2010 STIP for the Route 91 Widening – Route 55 connector to
Weir Canyon project (PPNO 4598A) in Orange County to advance the
schedule and split out the landscape work. Information only.
(1d) The Department and the Los Angeles County Metropolitan
Transportation Authority propose to amend the CMIA, STIP and TCRP
programs for the Route 5 High Occupancy Vehicle, Orange County Line to
Route 605 project (PPNO 2808) in Los Angeles County to split the
project into five constructible segments, revise the programmed amount
for Construction and Right of Way, and revise the schedule for staging
and construction purposes. Approved, as modified.
(1e) The San Bernardino Associated Governments (SANBAG) propose to
amend the CMIA Program to add the I-215 High Occupancy Vehicle (HOV)
Bi-County Gap Closure Project, to reprogram $15.5 million of CMIA
Private Placement Bond savings from the I-215 Segment 5 and Route 210/I-215 Connector Projects. Approved.
(1f) The Department and the Los Angeles County Metropolitan
Transportation Authority (LACMTA) propose to amend the CMIA Program to
add the I-10 High Occupancy Vehicle (HOV) Lanes from Citrus to Route 57 Project, to reprogram CMIA funds replaced by regional American
Recovery and Reinvestment Act of 2009 funds on the I-405 Carpool Lane
Project, in accordance with AB X3-20. Approved.
Proposition 1B Route 99 Program Amendments
(2a) The Department and Sutter County propose to amend the Route 99
Corridor baseline agreement for the Riego Road project (PPNO 3L44) in
Sutter County to add additional enhancements funded from award
savings. Approved.
(2b) The Department and the Sacramento Area Council of Governments
(SACOG) propose to amend the Route 99 Corridor baseline agreement for
the Elverta Road Interchange project (PPNO 0259D) in Sacramento County
to update the funding plan and schedule. Approved.
Proposition 1B TCIF Program Amendments
(5a) The Southern California Consensus Group, in conjunction with the
Port of Long Beach, propose to amend the TCIF Program and the TCIF
Project Baseline Agreement for TCIF Project 23: Gerald Desmond Bridge
Replacement Project requesting the Commission to program an additional
$49.795 million of TCIF to the project, amend the funding plan to
reflect the programming of $200 million of SHOPP funds and revise the
delivery schedule. Approved, as modified.
(5b) The Orange County Transportation Authority proposes to amend the
TCIF baseline agreements for two projects, Project 36 (Placentia
Avenue Undercrossing Project [PPNO TC36]), to update the project cost,
schedule, and funding plan and Project 38 (Kraemer Boulevard
Undercrossing [PPNO TC38]), to update the project schedule and funding
plan. Approved, as modified.
- 2.2c. Environmental Matters – Approval of Projects for
Future Consideration of Funding, Route Adoption or New Public Road
(1) Approval of Project for Future Consideration of Funding:
03-But-70, PM 28.2 Route 70 in Butte County. Seismic retrofit of an
existing bridge on Route 70 near the city of Oroville. (ND) (PPNO
2269) (SHOPP) The Commission accepted the environmental document
and approved the project for future consideration of funding.
(2) Approval of Project for Future Consideration of Funding and Route Adoption: 05-SLO-1, PM 64.0/R67.2 Route 1 in San Luis Obispo County.
Realignment of a portion of Route 1 near San Simeon. (FEIR) The
Commission accepted the environmental document, Findings of Fact,
and Statement of Overriding Considerations and approved the project
for future consideration of funding and route adoption.
(3) Approval of Project for Future Consideration of Funding:
05-SB-101, PM 2.2/3.4 Route 101 in Santa Barbara County. Roadway
improvements including reconstruction of interchanges, reconfiguration
of on and off ramps, and bridge replacements on Route 101 in the city
of Carpinteria. The Commission accepted the environmental
documents, the Findings of Fact, and approved the project for future
consideration of funding.
(4) Approval of Project for Future Consideration of Funding: 06-Kin-41, PM
R37.5/R38.1 Route 41 in Kings County. Construct roadway improvements
including left turn lanes in both directions on Route 41 near the city
of Lemoore. (MND) (PPNO 6456) (SHOPP) The Commission accepted the
environmental document and approved the project for future
consideration of funding.
(5) Approval of Project for Future Consideration of Funding: 06-Fre-180,
PM R58.4/R60.4 Route 180 in Fresno County. Construct new braided ramps
between Route 41 and Route 168 in the city of Fresno. (MND) (PPNO
6276A) (SHOPP) The Commission accepted the environmental document
and approved the project for future consideration of funding.
(7) Approval of Project for Future Consideration of Funding: 12-Ora-73, PM
10.0/24.5 Route 73 in Orange County. Stabilize slopes and medians for
erosion reduction at nine locations on Route 73 near the city
of Mission Viejoin the City of Irvine to south of
Greenfield Drive in the city of Laguna Hills. (MND) (PPNO
4051) (SHOPP) The Commission accepted the environmental document
and approved the project for future consideration of funding.
- 2.3a. Route Adoptions
(1) One Route Adoption as a conventional highway at -- 05-SLO-1- PM
64.0/R66.9 Route 1 in the county of San Luis Obispo from 0.3 mile
north of the Point Piedras Blancas to Arroyo De La Cruz creek. Approved,
as modified.
(2) One Route Adoption as a freeway at 07-LA-710 - PM 3.6/5.0 Route 710 in the county of Los Angeles from West Broadway to Terminal Island
Freeway Route 47. (Gerald Desmond) Approved, as modified.
(3) Rescission of Freeway Adoption in the City of Hayward and Alameda
County. -- 4-Ala-238 PM 9.2/14.8 Approved, as modified.
- 2.3c. Relinquishment Resolutions
02-Teh-99 - PM 18.0/18.2 Right of way in the county of Tehama along
Route 99 at 68th Avenue and Le Claire Avenue, consisting of
reconstructed county roads. Approved.
05-SLO-227- PM R10.26/R13.97 Right of way in the city of San Luis
Obispo on Route 227 (Broad Street, South Street, Higuera Street, and
Madonna Road), from the southerly city limits to Route 101. The City,
by resolution dated August 17, 2010, waived the 90-day notice
requirement and agreed to accept title upon relinquishment by the
State. Authorized by Chapter 650, Statutes of 2004, which amended
Section 527 of the Streets and Highways Code. Approved.
12-Ora-55 - PM 13.7 Right of way in the city of Orange along Route 55
at Chapman Avenue, consisting of collateral facilities.Approved.

Noted the following article, which has some interesting information but
really doesn't fit well into the site as currently laid out: Grading the Freeways. This article talks about recent reports in Southern California on freeway congestion, and provides rankings of all the routes
in terms of congestion and level of service. Some points highlighted are:
- Half of the freeway system operates at LOS E and F, the two most
congested levels, in the morning and afternoon rush hours. Almost 20% of
the arterial intersections operate at LOS E and F in the morning rush
hours, and just over 20% of the intersections operate at LOS E and F in
the afternoon.
- Freeway monitoring data indicates a highly complex travel pattern for
Los Angeles County, with many freeway segments experiencing congestion
in both directions during the morning and afternoon rush hours. This
differs from the traditional suburban to a central downtown commute
patterns.
- Some Los Angeles County freeways experience heavy congestion in both
directions during peak periods. These include: the Santa Monica Freeway
(Route 10) between the East LA Interchange and the San Diego Freeway
(Route 405); the Golden State Freeway (Route 5) between the Glendale
Freeway (Route 2) and the Hollywood Freeway (Route 170); and the Santa
Ana Freeway (Route 5) between Lakewood Boulevard (Route 19) and the
Orange County line.
Thanks to Robert Bregoff, noted the System Planning Documents for District 4 of Caltrans. I haven't had the time to go through them in detail, but they contain both the
Transportation Corridor Concept Reports (TCCR), which provide a specific
"highway operation concept configuration" for the year 2025, and the Route Concept Reports (RCR), which define the 20-year concept for route
development from 1985-2005. They also contain the analysis for
relinquishment of routes.

Reviewed the Pending Legislation page. Noted the passage/veto of the following:
- AB 619 (Blumenfield) Transportation projects: federal
funds: delays.
Existing law, the California High-Speed Rail Act, creates the High-Speed
Rail Authority to develop and implement a high-speed train system in the
state, with specified powers and duties. Existing law gives the
authority the power to, among other things, enter into contracts with
private or public entities for the design, construction, and operation
of high-speed trains. Existing law, the Safe, Reliable, High-Speed
Passenger Train Bond Act for the 21st Century, approved by the voters as
Proposition 1A at the November 4, 2008, general election, provides for
the issuance of $9.95 billion in general obligation bonds for high-speed
rail and related purposes. This bill would require any entity applying
for a contract with the authority for goods or services related to the
high-speed train network, as specified, to affirmatively certify whether
it had any direct involvement in the deportation of any individuals to
extermination camps, work camps, concentration camps, prisoner of war
camps, or any similar camps between specified dates during World War II.
The bill would also require the authority to acknowledge and note the
importance of complying with this certification, as provided.

- AB 1670 (Beall) State Highway Routes 82 and 130:
relinquishment.
This bill would authorize the commission to relinquish to the City of
San Jose specified portions of Route 82 and Route 130, under certain
conditions.

Chapter 448.
- AB 1871 (Jones) Private Passenger motor vehicle insurance
coverage: personal vehicle sharing.
This bill would prohibit a private passenger motor vehicle, as defined,
from being classified for insurance purposes as a commercial, for-hire,
or permissive use vehicle, or livery solely on the basis of it being
used for personal vehicle sharing, as defined, if the annual revenue
received by the vehicle's owner that is generated by personal vehicle
sharing does not exceed the annual expenses of operating the vehicle,
including, but not limited to, depreciation, interest, lease payments,
auto loan payments, insurance, maintenance, and fuel, and the personal
vehicle sharing is conducted pursuant to a personal vehicle sharing
program. The bill would define a personal vehicle sharing program as a
legal entity qualified to do business in the state that facilitates
personal vehicle sharing, as specified. The bill would require a
personal vehicle sharing program, among other things, during all times
that the vehicle is engaged in personal vehicle sharing, to provide
insurance coverage, as specified, and collect, maintain, and make
available to the vehicle owner and the vehicle owner's primary
automobile liability insurer verifiable electronic records identifying
the date, time, initial and final locations of the vehicle, and miles
driven when it is being used as part of the personal vehicle sharing
program. The bill would limit the circumstances under which the vehicle
owner's autmobile liability insurance can be subject to liability, and
require that automobile insurance policies not be canceled, voided,
terminated, rescinded, or nonrenewed on the basis that the private
passenger motor vehicle has been made available for personal vehicle
sharing. The bill would authorize the insurer of the vehicle to exclude
any and all coverage afforded under the vehicle owner's automobile
insurance policy while the vehicle is used by a person other than the
owner as part of a personal vehicle sharing program.

Chapter 454.
- AB 1944 (Fletcher) Vehicles: special license plates:
disabled veterans.
Under existing law, the Department of Motor Vehicles is required, upon
application and without additional fees, to issue a special license
plate or plates to a disabled person, a disabled veteran, or an
organization or agency involved in the transportation of those persons
pursuant to procedures adopted by the department. Existing law requires
the department, prior to issuing a special license plate to a disabled
person or disabled veteran, to require the submission of a certificate
signed by a medical professional, as provided, that substantiates the
disability of the person or veteran, in certain situations. This bill,
in addition, would require the department to accept, in lieu of the
certificate signed by a medical professional, a certificate from the
United States Department of Veterans Affairs that certifies the
applicant is a disabled veteran. Existing law authorizes a disabled
person or veteran to apply to the department for the issuance of a
distinguishing placard to be used in lieu of the special license plate.
Existing law requires the department, prior to issuing the placard to a
disabled person or disabled veteran, to require the submission of a
certificate signed by a medical professional, as provided, that
substantiates the disability of the person or veteran, in certain
situations. This bill, in addition, would require the department to
accept, in lieu of the certificate signed by a medical professional, a
certificate from the United States Department of Veterans Affairs that
certifies the applicant is a disabled veteran. This bill would
incorporate changes in Section 5007 of the Vehicle Code proposed by AB
2777 that would become operative only if both bills are enacted and this
bill is enacted after AB 2777. This bill would also incorporate
additional changes in Section 22511.55 of the Vehicle Code proposed by
AB 1855, or SB 1318, or both, to be operative only if AB 1855, or SB
1318, or both, and this bill are chaptered and become effective on or
before January 1, 2011, and this bill is chaptered last.

- AB 2098 (Miller) Riverside County Transportation
Commission: transportation projects: contracts.
Existing law, until January 1, 2014, allows certain state and local
transportation entities, if authorized by the California Transportation
Commission, to use a design-build process for contracting on
transportation projects, as specified. This bill would authorize the
Riverside County Transportation Commission, if authorized by the
commission, to utilize this design-build procurement process for the
Route 91 Corridor Improvements Project on the state highway system. The
bill would make the Department of Transportation responsible for the
performance of construction inspection services for the project, as
specified, and would require the commission to report on the progress of
the project and related matters to specified legislative committees. See

Resolution Chapter 162.
- SB 885 (Corbett) Gift certificates: redemption.
Existing law also provides that a gift certificate with a cash value of
less than $10 may be redeemed in cash, as defined, for its cash value.
Existing law prohibits the sale of a gift certificate that contains a
dormancy fee, subject to specified exceptions. This bill would delete
those exceptions and expressly prohibit the sale of a gift certificate
that contains a dormancy fee.

- SB 906 (Leno) Marriage.
Existing law defines marriage as a personal relation arising out of a
civil contract between a man and a woman, to which the consent of the
parties capable of making that contract is necessary. This bill would
instead define the term civil marriage as a personal relation arising
out of a civil contract between a man and a woman, established pursuant
to a State of California marriage license issued by the county clerk, to
which the consent of the parties capable of making that contract is
necessary. The bill would also make conforming related changes by
changing certain references to marriage to civil marriage. Existing law
enumerates persons who are authorized to solemnize a marriage,
including, but not limited to, any priest, minister, rabbi, or
authorized person of any religious denomination. The bill would specify
that no priest, minister, rabbi, or authorized person of any religious
denomination, or his or her religious denomination, would be required to
solemnize a marriage that is contrary to the tenets of his, her, or its
faith. The bill would state that any refusal to solemnize a marriage
under that provision shall not affect the tax exempt status of any
entity.

- SB 993 (Huff) State Highway Route 66: City of Claremont.
Existing law provides that the Department of Transportation has full
possession and control of all state highways. Existing law describes the
authorized routes in the state highway system and establishes a process
for adoption of a highway on an authorized route by the California
Transportation Commission. Existing law authorizes the commission to
relinquish certain state highway segments to local agencies. Existing
law described the authorized routes of Route 19 and Route 66 and
authorizes certain portions of those routes to be relinquished to the
specified cities. This bill would authorize the commission to relinquish
to the City of Lakewood the portion of Route 19 within its city limits
or sphere of influence under certain conditions. The bill would revise
the description of Route 66 to indicate portions of the route that have
been relinquished or that have been authorized to be relinquished, as
specified. The bill would also authorize the commission to relinquish to
the City of Claremont that portion of Route 66 within its city limits or
sphere of influence under specified conditions. The bill would
incorporate additional changes in Section 319 of the Streets and
Highways Code proposed by SB 1318, to be operative if SB 1318 and this
bill become effective on or before January 1, 2011, and this bill is
enacted last.

- SB 1318 (Numerous Senators) Transportation.
(1) Existing law establishes the State Highway System and designates
state highway routes from Route 1 to Route 905, unless otherwise
specified by name, and authorizes the California Transportation
Commission to relinquish all or a portion of designated state highway
routes to specified local agencies if certain conditions are met.
Portions of state highways that have been relinquished are not state
highways and become ineligible for future adoption as a part of the
State Highway System. This bill would acknowledge the relinquishment of,
and designate or make technical changes to, specific portions of Route 1, Route 2, Route 19, Route 39, Route 71, Route 72, Route 74, Route 79,
Route 83, Route 84, Route 111, Route 144, Route 151, Route 160, Route 164, Route 170, Route 260, and Route 275. Existing law authorizes the
commission to relinquish to the City of Bakersfield or the County of
Kern the portion of Route 58 that is located within the city limits of
the City of Bakersfield under certain conditions. This bill would
authorize the relinquishment to the City of Bakersfield and the County
of Kern those portions of Route 58 located within their respective
jurisdictions under certain conditions.

(3) Existing law authorizes the Department of Motor Vehicles to
establish requirements for equipment and devices to be used on any
vehicle and defines the types of vehicles for this purpose. Existing law
requires that license plates be securely fastened at all times to the
vehicle for which they are issued so as to prevent the plates from
swinging, be mounted in a position so as to be clearly visible, and be
maintained in a condition so as to be clearly legible. A violation of
the Vehicle Code is a crime. This bill would also require that license
plates be mounted in a position so that the characters are upright and
display from left to right.

Well, actually, it is Labor Day weekend, but I'm not going call this
September quite yet. Still, a holiday weekend affords me the luxury of

- AB 1500 (Lieu) High-occupancy lanes: single occupancy
vehicles: sunset date.
Existing law authorizes the Department of Transportation to designate
certain lanes for the exclusive use of high-occupancy vehicles (HOV),
which lanes may also be used, until January 1, 2011, by certain
low-emission and hybrid vehicles not carrying the requisite number of
passengers otherwise required for the use of an HOV lane if the vehicle
displays a valid identifier issued by the Department of Motor Vehicles.
Existing law, until January 1, 2011, makes it a misdemeanor to illegally
use a decal, label, or other identifiers issued by the department. This
bill would extend the date, to January 1, 2015, that specified vehicles
can use high-occupancy lanes, the department can issue low-emission and
hybrid decals or other identifiers, and illegal use of a
department-issued decal is considered a misdemeanor, creating a
state-mandated local program.

- AB 1908 (Cook) Vehicles: specialized license plates:
Veterans' organization.
Under existing law, the Department of Motor Vehicles (DMV) issues
environmental and other specialized license plates, including veterans'
organization license plates. Those license plates are required to have a
distinctive design or decal. The issuance of those license plates is
subject to additional fees, the revenue from which, less the DMV's
costs, is required to be deposited in the Veterans Service Office Fund,
except that ½ of a specified additional fee is required to be
deposited in the California Environmental License Plate Fund. Existing
law requires money in the Veterans Service Office Fund to be available,
upon appropriation by the Legislature, to the Department of Veterans
Affairs for allocation and disbursement to counties for the operation of
county veterans service offices. This bill would authorize the
Department of Veterans Affairs to modify the distinctive design or decal
for those veterans' organization license plates. The bill would
authorize those newly designed plates or decals to be issued only after
all existing plates or decals have been issued. The bill also would
delete the requirement that ½ of the specified additional fee be
deposited in the California Environmental License Plate Fund, and,
instead, would require all revenue from those additional fees, less the
DMV's costs, to be deposited in the Veterans Service Office Fund. The
bill would require the DMV, by July 1, 2011, to maintain on its Internet
Web site, a link to order online the veterans' organization license
plates.

- SB 535 (Yee) Vehicles: High-occupancy vehicle lanes.
(1) Existing law authorizes the Department of Transportation to
designate certain lanes for the exclusive use of high-occupancy vehicles
(HOVs), which lanes may also be used, until January 1, 2015, or until
the Secretary of State receives a specified notice, by certain
low-emission, hybrid, or alternative fuel vehicles not carrying the
requisite number of passengers otherwise required for the use of an HOV
lane, if the vehicle displays a valid identifier. A violation of
provisions relating to HOV lane use by vehicles with those identifiers
is a crime. This bill would revise that provision to provide that it
shall remain in effect only until the Secretary of State receives that
specified notice, with respect to a vehicle that meets California's
super ultra-low exhaust emission standard and the federal inherently
low-emission evaporative emission (ILEV) standard and a vehicle produced
during the 2004 model-year or earlier that meets the California
ultra-low emission vehicle standard and the ILEV standard. With respect
to all other vehicles described above, this provision shall be operative
only until July 1, 2011, or only until the Secretary of State receives
that specified notice, whichever occurs first. Existing law requires the
Department of Transportation to remove individual HOV lanes, or portions
of those lanes, during periods of peak congestion, after making certain
findings, including, among other things, a finding that the department
demonstrate the infeasibility of alleviating the congestion by other
means, including, but not limited to, reducing the use of the lane by
noneligible vehicles or further increasing vehicle occupancy. This bill
would delete this required finding. The bill, between January 1, 2012,
and January 1, 2015, would require the Department of Motor Vehicles to
issue up to 40,000 identifiers that are distinguishable from the
identifiers issued for low-emission, hybrid, and alternative fuel
vehicles to vehicles that meet California's enhanced advanced technology
partial zero-emission vehicle (enhanced AT PZEV) standard, except the
department's authorization to do so would end if the secretary receives
the specified notice before then. The bill would authorize vehicles with
that identifier to use HOV lanes until January 1, 2015, or until the
Secretary of State receives a specified notice, whichever occurs first.
By extending and changing the definition of a crime, the bill would
impose a state-mandated local program. The bill would make technical and
conforming changes. (2) The California Constitution requires the state
to reimburse local agencies and school districts for certain costs
mandated by the state. Statutory provisions establish procedures for
making that reimbursement.

- AB 619 (Blumenfield) Transportation projects: federal
funds: delays.
Existing law, the California High-Speed Rail Act, creates the High-Speed
Rail Authority to develop and implement a high-speed train system in the
state, with specified powers and duties. Existing law gives the
authority the power to, among other things, enter into contracts with
private or public entities for the design, construction, and operation
of high-speed trains. Existing law, the Safe, Reliable, High-Speed
Passenger Train Bond Act for the 21st Century, approved by the voters as
Proposition 1A at the November 4, 2008, general election, provides for
the issuance of $9.95 billion in general obligation bonds for high-speed
rail and related purposes. This bill would require any entity applying
for a contract with the authority for goods or services related to the
high-speed train network, as specified, to affirmatively certify whether
it had any direct involvement in the deportation of any individuals to
extermination camps, work camps, concentration camps, prisoner of war
camps, or any similar camps between specified dates during World War II.
The bill would also require the authority to acknowledge and note the
importance of complying with this certification, as provided.

- AB 1871 (Jones) Private Passenger motor vehicle insurance
coverage: personal vehicle sharing.
This bill would prohibit a private passenger motor vehicle, as defined,
from being classified for insurance purposes as a commercial, for-hire,
or permissive use vehicle, or livery solely on the basis of it being
used for personal vehicle sharing, as defined, if the annual revenue
received by the vehicle's owner that is generated by personal vehicle
sharing does not exceed the annual expenses of operating the vehicle,
including, but not limited to, depreciation, interest, lease payments,
auto loan payments, insurance, maintenance, and fuel, and the personal
vehicle sharing is conducted pursuant to a personal vehicle sharing
program. The bill would define a personal vehicle sharing program as a
legal entity qualified to do business in the state that facilitates
personal vehicle sharing, as specified. The bill would require a
personal vehicle sharing program, among other things, during all times
that the vehicle is engaged in personal vehicle sharing, to provide
insurance coverage, as specified, and collect, maintain, and make
available to the vehicle owner and the vehicle owner's primary
automobile liability insurer verifiable electronic records identifying
the date, time, initial and final locations of the vehicle, and miles
driven when it is being used as part of the personal vehicle sharing
program. The bill would limit the circumstances under which the vehicle
owner's autmobile liability insurance can be subject to liability, and
require that automobile insurance policies not be canceled, voided,
terminated, rescinded, or nonrenewed on the basis that the private
passenger motor vehicle has been made available for personal vehicle
sharing. The bill would authorize the insurer of the vehicle to exclude
any and all coverage afforded under the vehicle owner's automobile
insurance policy while the vehicle is used by a person other than the
owner as part of a personal vehicle sharing program.

- AB 1944 (Fletcher) Vehicles: special license plates:
disabled veterans.
Under existing law, the Department of Motor Vehicles is required, upon
application and without additional fees, to issue a special license
plate or plates to a disabled person, a disabled veteran, or an
organization or agency involved in the transportation of those persons
pursuant to procedures adopted by the department. Existing law requires
the department, prior to issuing a special license plate to a disabled
person or disabled veteran, to require the submission of a certificate
signed by a medical professional, as provided, that substantiates the
disability of the person or veteran, in certain situations. This bill,
in addition, would require the department to accept, in lieu of the
certificate signed by a medical professional, a certificate from the
United States Department of Veterans Affairs that certifies the
applicant is a disabled veteran. Existing law authorizes a disabled
person or veteran to apply to the department for the issuance of a
distinguishing placard to be used in lieu of the special license plate.
Existing law requires the department, prior to issuing the placard to a
disabled person or disabled veteran, to require the submission of a
certificate signed by a medical professional, as provided, that
substantiates the disability of the person or veteran, in certain
situations. This bill, in addition, would require the department to
accept, in lieu of the certificate signed by a medical professional, a
certificate from the United States Department of Veterans Affairs that
certifies the applicant is a disabled veteran. This bill would
incorporate changes in Section 5007 of the Vehicle Code proposed by AB
2777 that would become operative only if both bills are enacted and this
bill is enacted after AB 2777. This bill would also incorporate
additional changes in Section 22511.55 of the Vehicle Code proposed by
AB 1855, or SB 1318, or both, to be operative only if AB 1855, or SB
1318, or both, and this bill are chaptered and become effective on or
before January 1, 2011, and this bill is chaptered last.

Existing law, until January 1, 2014, allows certain state and local
transportation entities, if authorized by the California Transportation
Commission, to use a design-build process for contracting on
transportation projects, as specified. This bill would authorize the
Riverside County Transportation Commission, if authorized by the
commission, to utilize this design-build procurement process for the
State Route 91 Corridor Improvements Project on the state highway
system. The bill would make the Department of Transportation responsible
for the performance of construction inspection services for the project,
as specified, and would require the commission to report on the progress
of the project and related matters to specified legislative committees.

- SB 906 (Leno) Marriage.
Existing law defines marriage as a personal relation arising out of a
civil contract between a man and a woman, to which the consent of the
parties capable of making that contract is necessary. This bill would
instead define the term civil marriage as a personal relation arising
out of a civil contract between a man and a woman, established pursuant
to a State of California marriage license issued by the county clerk, to
which the consent of the parties capable of making that contract is
necessary. The bill would also make conforming related changes by
changing certain references to marriage to civil marriage. Existing law
enumerates persons who are authorized to solemnize a marriage,

that no priest, minister, rabbi, or authorized person of any religious
denomination, or his or her religious denomination, would be required to
solemnize a marriage that is contrary to the tenets of his, her, or its
faith. The bill would state that any refusal to solemnize a marriage
under that provision shall not affect the tax exempt status of any
entity.

- SB 993 (Huff) Route 66: City of Claremont.
Existing law provides that the Department of Transportation has full
possession and control of all state highways. Existing law describes the
authorized routes in the state highway system and establishes a process
for adoption of a highway on an authorized route by the California
Transportation Commission. Existing law authorizes the commission to
relinquish certain state highway segments to local agencies. Existing
law described the authorized routes of Route 19 and Route 66 and
authorizes certain portions of those routes to be relinquished to the
specified cities. This bill would authorize the commission to relinquish
to the City of Lakewood the portion of Route 19 within its city limits
or sphere of influence under certain conditions. The bill would revise
the description of Route 66 to indicate portions of the route that have
been relinquished or that have been authorized to be relinquished, as
specified. The bill would also authorize the commission to relinquish to
the City of Claremont that portion of Route 66 within its city limits or
sphere of influence under specified conditions. The bill would
incorporate additional changes in Section 319 of the Streets and
Highways Code proposed by SB 1318, to be operative if SB 1318 and this
bill become effective on or before January 1, 2011, and this bill is
enacted last.

- SB 1318 (Numerous Senators) Transportation.
(1) Existing law establishes the State Highway System and designates
state highway routes from Route 1 to Route 905, unless otherwise
specified by name, and authorizes the California Transportation
Commission to relinquish all or a portion of designated state highway
routes to specified local agencies if certain conditions are met.
Portions of state highways that have been relinquished are not state
highways and become ineligible for future adoption as a part of the
State Highway System. This bill would acknowledge the relinquishment of,
and designate or make technical changes to, specific portions of Route 1, Route 2, Route 19, Route 39, Route 71, Route 72, Route 74, Route 79,
Route 83, Route 84, Route 111, Route 144, Route 151, Route 160, Route 164, Route 170, Route 260, and Route 275. Existing law authorizes the
commission to relinquish to the City of Bakersfield or the County of
Kern the portion of Route 58 that is located within the city limits of
the City of Bakersfield under certain conditions. This bill would
authorize the relinquishment to the City of Bakersfield and the County
of Kern those portions of Route 58 located within their respective
jurisdictions under certain conditions.

(3) Existing law authorizes the Department of Motor Vehicles to
establish requirements for equipment and devices to be used on any
vehicle and defines the types of vehicles for this purpose. Existing law
requires that license plates be securely fastened at all times to the
vehicle for which they are issued so as to prevent the plates from
swinging, be mounted in a position so as to be clearly visible, and be
maintained in a condition so as to be clearly legible. A violation of
the Vehicle Code is a crime. This bill would also require that license
plates be mounted in a position so that the characters are upright and
display from left to right.

Updated a link into AARoads, as they start their dynamic link conversion

Reviewed the Pending Legislation page. In the assembly, over three months, just about 1100 new bills were
introduced; in the senate, over 500. One would think, over time, we would
get it closer to right than having to modify things more! As the OC
Register called it: squirrels, distracting folks from getting the real work done! There were some new

Approvals/Amendments, Proposition 1B CMIA Program/Project Amendments
(1b) The Department and the San Diego Association of Governments
propose to amend the Corridor Mobility Improvement Account Program
baseline agreement for the Route 5/805 North Coast Corridor –
Stage 1A Project – Unit 2 (PPNO 0716) project to replace CMIA
funds with regional funds from the Recovery Act. Approved.
(5) The Department and the San Diego Association of Governments
propose to amend the Trade Corridor Improvement Fund baseline
agreement and the 2008 STIP for the State Route 11 and Otay Mesa Port
of Entry (POE) project (PPNO 0999) to program $4,900,000 of Federal
Safe, Accountable, Flexible, Efficient Transportation Equity Act: A
Legacy for Users (SAFETEA-LU) Border Infrastructure Program funds to
PA&ED in FY 2009-10, and update the project description, schedule
and funding plan. Resolution TCIF-P-0910-04 Approved.
- 2.2c. Environmental Matters – Approval of Projects for
Future Consideration of Funding, Route Adoption or New Public Road
(5) 12-Ora-5, PM 8.58/9.35 Route 5 in Orange County. Roadway
improvements including lane widening and interchange reconfiguration
on Route 5 in San Juan Capistrano. (PPNO 2615) The Commission
accepted the environmental document and approved for the project for
future consideration of funding.
- 2.3b. New Public Road Connection
One New Public Road Connection to US 101 at 05-SLO-101 PM 6.4 (Willow
Road) in the community of Nipomo, in the county of San Luis Obispo. Approved.
- 2.3c. Relinquishment Resolutions
1-Lak-20-PM 12.85 Right of Way along Route 20 in the town of Nice,
county of Lake, at Collier Avenue, consisting of a reconstructed and
relocated county road.. Approved.
7-LA-405-PM 38.9/39.0 Right of Way adjacent to Route 405 in the city
of Los Angeles at Dickens Street, consisting of a collateral facility.
Approved.
12-Ora-5-PM 31.9/32.4 Right of Way in the city of Santa Ana along
Route 5 between Santa Ana Boulevard and Seventeenth Street, consisting
of relocated and reconstructed city streets and frontage roads Approved.
